Acceptance

These Terms govern your use of Kwipsy, the flashcard app operated by 큅시 (Kwipsy) ("Kwipsy", "we", "us"). By creating an account or using the app, you agree to these Terms. If you do not agree, do not use Kwipsy.

Eligibility

You must be at least 16 years old to use Kwipsy. If we learn that an account belongs to someone under that age, we will close it and delete the associated data, as described in our Privacy Policy.

Your account

You are responsible for the security of your account and for any activity that happens through it. Tell us at [email protected] if you believe your account has been accessed without your permission.

You can delete your account at any time in the app (Settings → Data & privacy → Delete account) or through our Delete Account page. What happens to your data then is described in our Privacy Policy.

Your content and the licence you grant us

You keep ownership of the decks, cards, notes, tags and media you create or import ("your content"). To run the service, you grant Kwipsy a licence to store, back up, transmit and reproduce your content solely as needed to provide Kwipsy to you — in particular, to sync it across your devices, include it in an export you request, and keep the backups described in our Privacy Policy. This licence ends when your content is deleted, subject to the backup timing described there.

Kwipsy Pro subscription

Kwipsy is free to download and use. Kwipsy Pro is an optional auto-renewable subscription that unlocks the features marked Pro in the app — in the current version, every Library deck in full, unlimited game rounds, and Insights with your full statistics history. The app shows what is free and what is in Kwipsy Pro before you buy.

• Plans. Kwipsy Pro is offered as a yearly plan and a weekly plan. The yearly plan includes a 7-day free trial for eligible new subscribers. The price of each plan is shown in the app and by the store, in your local currency, before you confirm the purchase.
• Payment. Payment is charged to your Apple ID or Google account when you confirm the purchase or, if you start a free trial, when the trial ends.
• Automatic renewal. The subscription renews automatically for the same period unless you cancel it at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.
• Free trial. If you cancel at least 24 hours before the trial ends, you are not charged. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Managing and cancelling. You can manage or cancel the subscription in your App Store account settings or in Google Play, depending on where you bought it. In Kwipsy, open Settings, tap your account at the top, and use the Manage link under Subscription. Deleting the app or your Kwipsy account does not cancel the subscription. After you cancel, Kwipsy Pro stays active until the end of the period you have already paid for.
• Refunds. Purchases are processed by Apple or Google, and refund requests are handled by them under their own policies. We cannot issue refunds for purchases made through a store.
• Your Kwipsy account. A subscription is linked to the Kwipsy account you were signed in to when you bought it, and Kwipsy Pro works on every device where you sign in to that account.
• Price changes. If the price of a plan changes, the store tells you in advance and, where its rules require it, asks for your consent before the new price applies.

App Store and Google Play

If you downloaded Kwipsy from the App Store, Apple's Licensed Application End User License Agreement — the Standard EULA — also applies to your use of the app. Purchases are also governed by the terms of the store you buy through.

Acceptable use

You will not upload or import content you do not have the right to use. This specifically includes:

• patients' medical records or other health information belonging to someone else;
• a current or former employer's confidential or proprietary documents; and
• another person's personal data, uploaded without their permission.

You will not use Kwipsy to store or distribute unlawful content, to attempt to gain unauthorised access to Kwipsy's systems or other users' accounts, or to interfere with the service's operation.

No warranty

Kwipsy is provided "as is", without warranties of any kind, express or implied, including warranties that it will be uninterrupted, error-free, or fit for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, 큅시 (Kwipsy) is not liable for indirect, incidental, or consequential damages arising from your use of Kwipsy. This limitation does not exclude or limit liability that cannot be excluded or limited under the law that applies to you.

Governing law

These Terms are governed by the law of the Republic of Korea. This does not deprive you of the protection of any mandatory consumer-protection rules in the country where you live, which continue to apply alongside these Terms.

Changes to these Terms

If we make a material change to these Terms, we will post the change here and update the date at the top of this page.
